Welcome to 文言文戰爭 (“the App”). These Terms of Service (“Terms”) govern your access to and use of our applications, websites, and services (collectively, the “Service”), operated by Hagen Creative (“we,” “us,” or “our”).

By creating an account or using our Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization.

1. Description of Service

文言文戰爭 provides software tools designed to help users manage, analyze, optimize, and automate advertising campaigns on platforms owned by Meta Platforms, Inc. (“Meta”), including Facebook, Instagram, and Messenger.

2. Relationship with Meta Platforms, Inc.

Independent Entity: We are an independent third-party software provider. We are not affiliated, associated, authorized, endorsed by, or in any way officially connected with Meta Platforms, Inc., or any of its subsidiaries or affiliates.
Meta Terms Compliance: To use our Service, you must connect your Meta Advertising account via Meta’s application programming interfaces (APIs). You are solely responsible for ensuring that your use of our App and your advertising campaigns comply with all Meta Advertising Standards, Meta Platform Terms, and Community Standards. Any violation of Meta’s terms by you may result in the immediate termination of your access to our Service.
Platform Changes: Meta frequently updates its APIs, data access permissions, and advertising algorithms. We are not liable for any service disruptions, loss of functionality, or changes to features resulting from modifications made by Meta to its platform or API policies.

3. User Accounts and Security

Eligibility: You must be at least 18 years old (or the legal age of majority in your jurisdiction) and possess the legal authority to bind your business or entity to these Terms.
Credentials: You must maintain the confidentiality of your account login credentials. You are entirely responsible for all activities that occur under your account.
API Access: By linking your Meta account, you grant the App permission to access, modify, download, or manage your Meta Ads data in accordance with the permissions you approve during authorization. You can revoke this access at any time via your Meta Business Integration settings.

4. Permitted Use and Restrictions

You agree not to, and will not allow any third party to:

Use the App to create, manage, or optimize ads that violate applicable laws, regulations, or Meta’s Advertising Policies (e.g., promoting illegal substances, deceptive practices, or discriminatory targeting).
Scrape, extract, or harvest data from the App or Meta’s platform using unauthorized automated tools.
Attempt to circumvent, reverse-engineer, or breach any security or rate-limiting measures implemented within the App or Meta’s APIs.
Use the App to process, store, or transmit data belonging to minors under the digital age of consent.

5. Data Privacy and Security

Your privacy and data security are critical. Our collection and use of your data, as well as the data retrieved from your Meta Ad accounts, are governed by our [Link to Privacy Policy].

Data Use Limitation: In compliance with Meta’s Developer Policies, we only access and use your Meta Technology Data to run, support, and improve the specific experience you request.
Data Deletion: If you delete your account or revoke our access, we will delete or anonymize your cached Meta Ad data within the legally required timeframe, except where retention is required by applicable law.

6. Fees and Payment

Subscription: Certain features of the App are provided on a paid subscription basis. You agree to pay all applicable fees specified at the time of purchase.
Cancellations & Refunds: Subscription renewals are billed automatically unless canceled prior to the renewal date. Refund policies are governed by our separate billing policy [Link to Billing Policy].
Meta Ad Costs: Fees paid to us cover only the software service we provide. You remain solely responsible for paying Meta directly for any actual advertising spend incurred through your campaigns.

7. Intellectual Property

We retain all rights, title, and interest in and to the App, including all software, design elements, logos, and proprietary algorithms. You are granted a limited, non-exclusive, non-transferable, and revocable license to use our Service solely for your internal business operations.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL GENERATE SPECIFIC ADVERTISING RESULTS, ROAS (RETURN ON AD SPEND), OR THAT IT WILL RUN COMPLETELY ERROR-FREE.

9. Limitation of Liability

TO the MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL [Insert Company Name] BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP OR ANY ACTIONS TAKEN BY META REGARDING YOUR AD ACCOUNT (INCLUDING ACCOUNT SUSPENSIONS, BANNINGS, OR AD REJECTIONS).

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, if we believe you have breached these Terms, violated Meta’s core policies, or engaged in fraudulent activity.

11. Governing Law and Dispute Resolution
